General terms and conditions

1. Scope of application

The General terms and conditions regulate the legal relationships between visitors and GRIPS Theater. They become part of the contract that comes into existence through the purchase of an admission ticket. Pre-ordering tickets is equivalent to purchasing them.

2. Programme and starting times

The programme and the starting times of the individual events can be found in the publications of GRIPS Theater. Information in the press is not binding. GRIPS Theater reserves the right to make changes to the cast and programme.

3. Ticket prices

The ticket prices applicable for the respective season can be found in the publications of GRIPS Theater. Payment at the advance booking office can be made in cash, by EC card or by credit card (Master, VISA). A processing fee is charged for sending tickets.

4. Discounts

GRIPS Theater offers discounted tickets for certain groups of visitors. The theatre is entitled to allocate discounts. Customers have to prove that they are entitled to a discount when the tickets are picked up at the box office and at the entrance when attending a performance. If the inspection reveals that the full price was unjustifiably not paid, GRIPS Theater shall be entitled to charge the difference. Subsequent assertion of discount claims is not possible. The accumulation of several reductions is excluded.

Discounts are partly granted on the basis of vouchers that can only be purchased from JugendKulturService under the applicable conditions of the Senate Department for Education, Youth and Family.

5. Ticket sales

5.1. Start of advanced sale

Advance sales usually begin on the day of publication on the GRIPS Theater homepage (www.grips-theater.de). GRIPS Theater reserves the right to change dates.

5.2. Sale of single tickets

GRIPS Theater offers the purchase of theatre tickets and reservations at the box office and via the website www.grips-theater.de. Reservations can also be made by phone.

Reserved tickets must be paid for by the date given when making the reservation. After this period the reservation expires. The tickets can be picked up at the box office, sent for a shipping fee of 3 Euro or deposited at the box office.

In the case of electronic ticket sales, there is no right of revocation or withdrawal according to §312g German Civil Code. Every ticket order is binding immediately after confirmation by the GRIPS Theater and obligates the acceptance of the tickets ordered.

Purchased tickets and change must be checked immediately to ensure that they are correct. For subsequent complaints, the burden of proof lies with the theatre visitors.

If the tickets are lost, no replacement will be issued.

GRIPS Theater reserves the right to limit the number of tickets that are sold per person and the advance booking in terms of time and/or with regard to the sale of discounted tickets and/or with regard to certain distribution channels.

5.3. Sale for groups

Special discount regulations apply to groups.

Reservations for groups are possible for a limited period of time (usually 14 days). The theater reserves the right to establish different deadlines.

A ticket order is considered a binding order, with the result that GRIPS Theater has a claim to payment even if the tickets are not picked up. The confirmation from the theatre must be checked immediately to ensure that it is correct. A complaint can only be made within two days of receipt of the confirmation/delivery note.

If reserved tickets are sent by post at the customer's request, GRIPS Theater shall charge a processing fee.

5.4. Tickets through visitor organisations

Tickets are also sold at external box offices, internet portals, visitor organisations and other cooperation partners. The respective, possibly deviating, terms and conditions of the named partners apply for which GRIPS Theater assumes no liability.

5.5. Payment

Payment can be made in cash, by direct debit or by credit card (only Visa or Master Card). Payment can also be made by redeeming valid vouchers issued by GRIPS Theater.

In the case of reversals of direct debits, the company can demand a reasonable processing fee.

5.6. Return of tickets

As a rule, tickets cannot be returned. In particular, a change in cast does not entitle the holder to return tickets that have already been purchased. It is possible to exchange tickets for a performance of the same production at a different date for a processing fee of 3 Euro per ticket.

Groups (20 people or more) can cancel a maximum of two tickets per class (20-30 students) up to the day of the performance. These tickets must be returned no later than 30 minutes before the start of the performance.

Tickets that have not been purchased directly from the box office or the GRIPS Theater website cannot be returned. The return of these tickets is subject to the terms and conditions of the respective seller.

5.7. Cancellation and termination

If an equivalent substitute performance is offered when the programme is changed, the tickets remain valid. A return is however possible.

If a performance is cancelled or interrupted, the tickets can be returned within two weeks from the day on which the performance was supposed to take place. After that, the right to a refund expires.

Beyond the right to reimbursement of the ticket price, further expenses or damage to the visitors shall not be reimbursed.

5.8. Resale

The resale of tickets for GRIPS Theater at increased prices and/or for commercial purposes is only permitted for contractual partners of the theatre.

6. Vouchers

Vouchers for the purchase of tickets or articles from GRIPS Theater can be purchased for a sum freely selectable by the customer. Vouchers are valid for three years from the date of purchase. They are excluded from return and cash payment. Remaining amounts will be issued as a new voucher.

7. Admission

The theatre opens one hour before the performance begins. Admission depends on the circumstances of the staging. After the performance has started, visitors can only be admitted at a suitable time, out of consideration for the participating artists and other visitors, and only after the admission staff has given instructions. There is no entitlement to admission for late arriving visitors if the artistic concept does not allow this.

8. Cloak room

Bulky items (such as coats, umbrellas, pieces of luggage and similar items) may not be taken into the auditorium, but rather must be left at the cloakroom for safekeeping during the visit to the performance. The conditions posted there apply to storage in the cloakroom.

9. Right to determine entry

The theatre management is entitled to domiciliary rights and these can be transferred by them to the staff (especially the presentation service). The instructions of those authorised to exercise the domiciliary rights must be followed. The house rules of GRIPS Theater apply.

10. Image rights

With the purchase of the ticket or as a participant in public events at the house, the visitors agree that photos and video recordings of them can be used online and offline as part of the public relations work of GRIPS Theater, unless they expressly contradict this. This consent is valid without time or space restrictions and is expressly waived without any claim to remuneration.

A clearly visible sign in the entrance area of the theatre informs our visitors if photographs are taken. This rule does not apply to children and young people who visit the theatre without their legal guardians. In this case, photo and video recordings of children and adolescents under the age of 18 will only be made with the prior consent of the legal guardian and the children or adolescents.

The rules of the KUG (law on copyright in works of the visual arts and photography) apply.

11. Data protection

The personal order data of visitors are collected, processed, stored and used in compliance with data protection law to the extent necessary for the initiation and implementation of the contract. In addition, GRIPS Theater is entitled to save and use the data for its own purposes. The privacy policy regulates further details.

12. Liability

The theatre is only liable for damage of any kind suffered by a visitor in the premises of GRIPS Theater in the event of gross negligence and wilful misconduct. GRIPS Theater does not take part in a dispute settlement procedure before a consumer dispute settlement body.

13. Catering

The catering business is managed by the respective private tenant. Corresponding contracts are only concluded with it.

14. Effectiveness of the General terms and conditions

The invalidity of an individual regulation or partial regulation does not lead to the invalidity of these General terms and conditions as a whole. German law applies exclusively. The place of performance and jurisdiction is Berlin. The General terms and conditions have been in force since 1 January 2019.

1. Contract

These General terms and conditions apply to all deliveries between us, GRIPS Theater, and a consumer in the version valid at the time of the order for online orders in the GRIPS shop.

Consumers, hereinafter referred to as the customer, are any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

The presentation of the goods in the GRIPS shop does not represent a legally binding contract offer on our part, but rather is only a non-binding invitation to the customer to order goods.

By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract.

The contract comes about with the binding sending of the order by clicking the button “buy” (for order type PayPal) or “order with obligation to pay” (for order type prepayment transfer) in the GRIPS shop

The GRIPS shop sends the customer an email as a contract confirmation with the invoice and these General terms and conditions as well as the statutory cancellation policy and cancellation form.

2. Prices, payment, due date

All prices quoted include the statutory sales tax and other price components. Shipping costs are to be added.

The customer has the option of paying in advance by bank transfer or by PayPal in advance:

Prepayment PayPal: The ordered items are dispatched immediately. The customer receives an invoice by email, which is marked as paid.

Prepayment transfer: The customer receives an invoice by email. The customer undertakes to pay the payment amount immediately. After that, the ordered items will be dispatched.

The regulations in the section “Shipping costs and delivery times” apply to shipping costs and delivery dates.

For security reasons, the order details of the customer are no longer accessible via the Internet after the order process has been completed.

3. Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

5. Shipping costs and delivery times

The shipping costs apply at a flat rate per order, regardless of the weight or number of items, and include all packaging and postage costs.
 
In the case of payment in advance, the deadline for delivery begins on the day after the payment order is issued to the transferring bank or, in the case of other payment methods, on the day after the contract is concluded and ends with the expiry of the last day of the deadline. If the first or last day of the period falls on a Saturday, Sunday or a public holiday recognised by the State at the place of delivery, the next working day will take the place of such a day.

6. Right of revocation of the customer

The customer has the right to withdraw from this contract without giving reasons. The period ends fourteen days from the day that you, or any third party authorised by you other than the carrier, have accepted delivery of the every item in your order. 

The right of revocation does not apply to a contract for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery. 

To exercise your right of revocation, you must inform us (GRIPS Theater gGmbH, Altonaer Str. 22, 10557 Berlin, Telephone +49 (0) 30 - 39 74 74 0, Fax +49 (0) 30 - 39 74 74 28, email info[at]grips-theater.de) by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached sample revocation form for this purpose, but this is not mandatory. 

In order to comply with the revocation period, you simply need to send us notice that you are exercising your right of revocation before the revocation period has expired. 

Consequences of revocation 

If you choose to revoke this contract, we shall refund all payments which we have received from you without delay, including shipping costs (except for additional costs arising in the event of selecting a shipping method which is different from the most cost-efficient standard delivery offered by us), no later than fourteen days from the date on which we have received the notice of revocation of this contract. The refund shall be issued with the same payment method which you provided for the original transaction, unless otherwise explicitly agreed with you; under no circumstances shall you be charged fees to process this refund. We may withhold the refund until the items have been returned to us, or until you have provided evidence that you have shipped the goods, whichever takes place first. 

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the revocation of this contract. The deadline shall be deemed to have been observed if you send the items before the fourteen-day deadline has expired. 

You shall bear the direct costs of returning the goods. 

You must only compensate any loss of value of the goods if this loss of value is due to handling which is unnecessary for the examination of the nature, characteristics and functioning of the goods.
